Zenkins Technologies respects the intellectual property rights of others and expects the same in return. This page outlines our policy for handling copyright infringement claims. While we follow principles aligned with the Digital Millennium Copyright Act (DMCA), Title 17, United States Code, Section 512(c) for global claimants, all matters are subject to the laws of the Republic of India and the exclusive jurisdiction of courts in Ahmedabad, Gujarat, India, including the Copyright Act, 1957 (India) and the Information Technology Act, 2000 (India).

As an internet service provider, Zenkins Technologies is entitled to claim immunity from infringement liability under the “safe harbor” provisions of the DMCA, provided we respond appropriately to valid takedown notices.

1. Filing a Copyright Infringement Claim (Takedown Notice)

If you believe that content on zenkins.com infringes your copyright, you may submit a formal takedown notice to our designated DMCA Agent. To be considered valid, your notice must include all of the following:

  1. Signature — A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
  2. Identification of the Copyrighted Work — A clear description of the original copyrighted work you claim has been infringed. If multiple works are involved, a representative list is acceptable.
  3. Identification of the Infringing Material — Specific information about the content you believe is infringing, sufficient for us to locate it on our platform. Please include the full URL of the page in question.
  4. Your Contact Information — Your full name, physical mailing address, email address, phone number, and fax number (if applicable).
  5. Good Faith Statement — A statement that you have a good faith belief that the disputed use of the material is not authorized by the copyright owner, their agent, or applicable law.
  6. Accuracy & Authority Statement — A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

⚠️ Important: Under 17 U.S.C. §512(f), any person who knowingly and materially misrepresents that content is infringing may be subject to civil damages, including costs and attorney’s fees.

Please note: By submitting a takedown claim, you acknowledge and agree that your identity and claim details may be shared with the alleged infringer as required by law.

2. Counter-Notification (Disputing a Takedown)

If material belonging to you has been removed from our Site as a result of a copyright claim and you believe the removal was made in error or based on misidentification, you may submit a counter-notification to have the material restored.

Your counter-notification must contain all of the following, as required under 17 U.S.C. §512(g)(3):

  1. Your Signature — A physical or electronic signature.
  2. Description of Removed Material — A description of the material that was removed and the URL or location where it appeared before removal.
  3. Good Faith Statement — A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your Contact Information & Jurisdictional Consent — Your full name, physical address, and phone number, along with a statement that:
    • You consent to the exclusive jurisdiction of the competent courts in Ahmedabad, Gujarat, India; and
    • You will accept service of process from the party who filed the original infringement notice.

3. Repeat Infringer Policy

Zenkins Technologies takes copyright infringement seriously. In accordance with the DMCA’s repeat infringer policy requirements, we:

  • Maintain a record of all DMCA takedown notices received from copyright holders.
  • Make a good faith effort to identify users or accounts associated with repeated infringement.
  • Terminate accounts of users found to be repeat infringers under our internal policy.

4. Modifications to This Policy

Zenkins Technologies reserves the right to modify this DMCA Policy at any time and for any reason. We encourage you to review this page regularly to stay informed of any updates.
